Oh boy, I can't wait for anybody he sues going to court and playing a compilation of every time Phil has openly stated that all the "detractor" channels take clips from his streams out of context and edit them to spread false information about him and that it's all fake and if they want the truth, to watch his channel. Phil is really his own worse enemy and I'm pretty sure any laywer worth his salt would be telling his Phil to shut his mouth and not talk about a potential legal case he plans on taking.

I want to see the clips of him giving permission and the one where he says permission can't be rescinded like he claimed with EvilAJ.

DSP just went into more detail about his plan to ask a "monthly" or "discounted annual fee" from detractor channels as some form of a "subscription service", which would mean they can sign a contract that prevents legal action against them. He also reiterated that all detractor content is being tracked "day by day, hour by hour" by "certain parties" and that "all this evidence will be used in the future".

I still don't believe he's doing shit. I'm sure he's using this as a way to create drama for some cheap donos (and it's working). phil is special needs, but he's sociopathic as hell. He know how to play one peoples' emotions and using this as a way to "shock" people into donating. don't take him seriously.
1-lawsuits takes a shit ton of money and time
2-not all De ack ack ack tors are from the us. and with america's image right now, other countries' justice systems would wipe their asses with any legal filing coming from a special needs 43 year old man from washington.
3-there is very little to no proof of lost of income. so most courts wouldn't care about it since bring people to court over this would be a violation of the 1st amendment since phil is using this as a way to get people to stop making fun of him.
4-the courts don't care about online drama.

also, since phil is a nobody and hardly bring in cash, youtube wouldn't care about any DMCA he would file.

I posted something similar in the main thread but what I suspect happened is phil went to visit his parents and acted like a paranoid retard the entire time and embarrassed himself and now he finally wants revenge on the trolls for making him look like that in front of his parents.

If phil was jumping up to look out the window whenever he heard a loud noise outside at his parent's house like he does at home or refused to go out to restaurants or go anywhere in public because a detractor might see him, this probably freaked his parents out and gave them the impression that internet trolls are actually stalking him and they probably encouraged phil to fight back. His parents giving him pep talks to fight back probably has him feeling emboldened right now but this feeling will die down once he gets back set in his old routine.

I think the onus would be on Raw Phil to prove the work is transformative.

The onus is Phil to prove his case. If Phil has nothing, then Raw Phil doesn't have to do anything; detractors win by default.

If Phil does have enough evidence to proceed to court (which is a pipe dream), then Raw Phil would have to defend himself against Phil's claims. And just getting to court will cost major bucks, which is another reason this threat is going nowhere.

Phil is a coward who would be scared by vague legal threats, so he thinks detractors will be scared too. He wants the detractors to throw him money on the back of one baseless threat he has no intention of carrying out.

Sorry Phil, no easy money for you. You'll be begging on Level 1 until you croak.

Ethan Kike's "they called me a Zionist" lolsuits are retarded because malicious intent is not an element for copyright infringement, he's wealthy enough to push them through anyway, but if DSP thinks he's gonna do the same he's even more detached from reality than I thought.

Malicious infringement just plays in to it being willful neglect and can have an impact when damages are calculated. That's why Klein got lucky when 3 of the people he hates openly admitted to being acting as a marketplace substitution.

But he's also jew-brained so he was clever enough to register his video prior to it's release so he's entitled to statutory damages if he wins which is the only reason it's worth suing. Easier to get high damages and easier to recover attorney's fees.

It's an entirely different situation for Phil because he would be trying to sue clips channels for actual damages vs statutory. Clip channels are almost guaranteed to be transformative in nature, even without commentary, because they're cutting 3-4 hour streams down to 10-15 minutes usually.

Also yeah, Phil doesn't have money to front any kind of lawsuit.

Just had a thought. Phil wants, from what I understand, a License for his Content so detractors have to pay him to use his "Content". A reminder that YouTube also has a Content Id System that gives rightholders access to the Ad Revenue made from Videos that reuse said licensed content (for example Videos that use licensed Music, in your Youtube Studio it will state that "rightsholder allows use but Ad Revenue will be diverted to the Rights holder"). For the old guys do you remember the shortlived Laveria / Fultabi arc? They offered Phil a managed partnership and they would claim the then popular TIHYDP Videos, put ads on them so that Phil would rake in cash for "free" so to speak. Well, we all know how that ended. But could it possibly be that someone has snuck this particular thought into his oddly shaped head?
